These Terms of Use (“Terms”) govern your access to and use of Better Utah Institute’s Civic Engagement Toolkit (“Toolkit”). Please read these Terms carefully, and contact us if you have any questions. By accessing or using the Toolkit, you agree to be bound by these Terms.
You may use the Toolkit only if you can legally form a binding contract with Better Utah Institute, and only in compliance with these Terms and all applicable laws. When you create your Toolkit account, you must provide us with accurate and complete information. Any use or access by anyone under the age of 13 is not allowed.
We wrote this policy to help you understand what information we collect and how we use it.
When you sign up for or use the Toolkit, you voluntarily share certain information including your name, email address, demographic information, and any other information you give us.
When you use a website, application, or other internet service, certain internet and electronic network activity information gets created and logged automatically. This is also true when you use this Toolkit. We use “cookies” or similar technologies to gather information (“log data”), including information that your browser automatically sends whenever you visit a website. This log data includes your Internet Protocol address (which we use to infer your approximate location), browser type and settings, the date and time of your request, how you used the Toolkit, and device data.
We use your information to provide and improve your experience on the Toolkit, including identifying you when you use the Toolkit, personalizing different features of the Toolkit, and responding to your questions and feedback.
We also have a legitimate interest in improving the Toolkit and may additionally use your information to conduct analytics and research on who is using the Toolkit and what they are doing.
Under the terms of grant agreements that made this Toolkit possible, we will share certain demographic information with government agencies or other organizations, without your personal identifying information.
We will share your information with other services, at your discretion, when you publish your information to them. For example, if you choose to publish the results of any quizzes or surveys to Facebook or Twitter, then information about that content will be shared with Facebook or Twitter.
We will share your information with third-party companies that we or they use to audit or improve the delivery and performance of ads or content on this Toolkit (for example, through Google Analytics).
We may share your information with our affiliates, including Alliance for a Better Utah.
We may change this policy from time to time and if we do, we’ll post any changes here. If you continue to use the Toolkit after those changes are in effect, you agree to the new policy.
We care about the security of our users. While we work to protect the security of your account and personal information, Better Utah Institute can’t guarantee that unauthorized third parties won’t be able to defeat our security measures. We ask that you keep your password secure. Please notify us immediately of any compromise or unauthorized use of your account.
The Toolkit and all of its content, features, and functionality (including but not limited to all information, text, displays, images, video and audio, and the design, selection, and arrangement thereof), are owned by Better Utah Institute, its licensors, or other providers of such material and are protected by United States copyright, trademark, and other intellectual property or proprietary rights laws.
These Terms grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Toolkit. You may access the material on the Toolkit only for your own personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works of, republish, download, or transmit any of the material on the Toolkit, except as incidental to normal web browsing, such as the making of temporary copies in RAM or the cache of your internet browser, and for features of the Toolkit that enable sharing via e-mail, social media, and other uses enabled by the Toolkit.
Any use of the Toolkit not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.
Better Utah Institute may terminate or suspend your right to access or use the Toolkit for any reason and at any time.
The Toolkit is provided on an “as is” basis without warrant of any kind, whether express or implied. Better Utah Institute specifically disclaims any and all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTER UTAH INSTITUTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE TOOLKIT; (B) ANY CONDUCT OF ANY THIRD PARTY ON THE TOOLKIT; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR INFORMATION.
For any dispute you have with Better Utah Institute, you agree to first contact us and try to resolve the dispute with us informally. If we need to contact you, we will do so at the email address on your account.
These Terms shall be governed by the laws of the State of Utah, without respect to its conflict of laws principles. The exclusive place of jurisdiction for all disputes arising from or in connection with this agreement is Salt Lake County, Utah, or the United States District Court for the District of Utah, and our dispute will be determined under Utah law.
We reserve the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if that’s what we decide. We may revise these Terms from time to time and the most current version will always be posted on our website. If a revision, in our discretion, is material, we’ll notify you. By continuing to access or use the Toolkit after revisios become effective, you agree to be bound by the new Terms. If you don’t agree to the new Terms, please stop using the Toolkit.
These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Better Utah Institute without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.
These Terms and any amendments and any additional agreements you may enter into with Better Utah Institute shall constitute the entire agreement between you and Better Utah Institute concerning the Toolkit. If any provision of these Terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Better Utah Institute’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

This Privacy Policy outlines the types of personal information we gather when you use services provided on the Better Utah Institute website as well as some of the steps we take to safeguard it.
The following principles apply to the personally identifying information we ask for and that you provide. “Personally identifying information” is information that individually identifies you, such as your name, physical address or email address.
Upon your first visit to the Better Utah Institute website, a cookie is sent to your computer that uniquely identifies your browser. A “cookie” is a small file containing a string of characters that is sent to your computer when you visit a website. We use cookies to improve the quality of our service and to better understand how people interact with us. We do this by storing user preferences in cookies and by tracking user trends and patterns of how people search. Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Better Utah Institute features or services may not function properly without cookies.
We do not rent or sell your personally identifying information to other companies, organizations or individuals. We may share such information in any of the following limited circumstances:
In the event of a transfer of ownership of Better Utah Institute such as acquisition by or merger with another organization, we will provide notice before any personally identifying information is transferred and becomes subject to a different privacy policy. We may share aggregated information with others, such as the number of supporters who sign a petition. We may also provide this information to groups in our public interest network, but we will never sell your personal information or share it with outside organizations unless expressly noted.
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. We restrict access to your personally identifying information to employees who need to know that information in order to operate, develop or improve our services.
Please note this Privacy Policy will change from time to time. We expect most such changes to be minor, but there may be changes that are more significant. Regardless, we will post those changes on this page and, if the changes are significant, we will also provide a more prominent notice. Each version will be noted at the top of the page. Prior version of this policy will be kept in an archive for you to view.
